Services of a Legal Expert
The Government of the Republic of Maldives has received grant funds from Scaling Up Renewable Energy Program (SREP) under the multi-donor Strategic Climate Fund, administered by the World Bank, towards the cost of Accelerating Sustainable Private Investment in Renewable Energy (ASPIRE) Project and intends to apply part of the proceeds of this grant to eligible payments under the contract for the Services of a Legal Expert.
The objective of this assignment is to provide advisory services to the ASPIRE project to oversee the legal aspects with regard to the implementation of the ASPIRE project, which will cover the installation of 4MW of solar PV systems in Male’ and Hulhumale’ (first phase), and subsequent phases that will come under ASPIRE framework, which includes the SIDSDOCK program. Specifically, the consultant will address the following, consistent with the ASPIRE project framework, and in coordination with the Project Management Unit (PMU). a) Critical review of the transaction documents of the project, and advise on legal issues that may arise during the bidding and post bidding stages. b) Support MEE during bidding process and assist in any negotiation stages following the award of contract to the bidder(s). c) Contribute to the development of the monitoring and evaluation framework for all sub-projects based on the ASPIRE project and experience.
The Ministry of Environment and Energy now invites interested eligible individuals to indicate their interest in providing the Services. Interested individuals should provide their CV with information demonstrating that they are qualified to perform the services (description of similar assignments, experience in similar conditions, availability of appropriate skills, etc.). The shortlisting criteria are: (i) should hold as a minimum a Masters level degree in law and have 7 years of experience in providing legal advisory services within Maldives, particularly in commercial aspects of investment projects; (ii) should have a good grasp of the commercial laws applicable to the Maldives relevant to the scope of the overall ASPIRE project; and (iii) Experience in international commercial transactions in the areas of Public Private Partnership (PPP) in particular power projects including renewables would be considered as an added advantage.
The attention of interested individuals is drawn to paragraph 1.9 of the World Bank’s Guidelines: Selection and Employment of Consultants under IBRD Loans and IDA Credits and Grants by World Bank Borrowers dated January 2011, setting forth the World Bank’s policy on conflict of interest.
