Assignment Title: Hiring a Consultant for TA to Craft a Digital Identity and Services Bill

The Government of Maldives (GoM) has received financing from the World Bank toward the cost of the Digital Maldives for Adaptation, Decentralization and Diversification (D’MADD) Project, and intends to apply part of the proceeds for consulting services.

The Consulting Services (“the services”) is to engage an experienced and qualified firm (The Consultant) to prepare a draft Digital Identity and Services Bill that would build trust between the government (as the identity provider) and the people/businesses (the users and beneficiaries of the system) and enable people to authenticate themselves securely and conveniently when obtaining/providing online digital services.

The Ministry of Homeland Security and Technology (MoHST) now invites eligible consulting firms (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services. The shortlisting criteria are: (i) The firm should have a thorough understanding of digital identification, data protection/ cybersecurity matters, and experience advising on law reform processes, drafting bills/legislations, and advising on data protection matters, with demonstrable knowledge and experience in similar assignments described in this TOR, (ii) The firm should have at least have five (5) years of experience providing relevant advice in highly developed, complex legal and sectoral contexts. Minimum of two (2) completed drafting bills/legislation projects.  Relevant experience in emerging economies and developing countries will be an advantage. Knowledge of and experience in the legal system in the Maldives is highly desirable. Key Experts will not be evaluated at the shortlisting stage. However, Firms are required to clearly state the proposed position for each Key expert proposed.

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” Fourth Edition dated November 2020 (Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest. 

Consultants may associate with other firms to enhance their qualifications but should indicate clearly whether the association is in the form of a joint venture. In the case of a joint venture, all the partners in the joint venture shall be jointly and severally liable for the entire contract, if selected.

A Consultant will be selected in accordance with the Quality and Cost-based Selection (QCBS) method set out in the Procurement Regulations.
